France: Girl, 11, ‘consented’ to sex says lawyer for man, 29

The Pontoise Criminal Court requested a new rape investigation on Tuesday in the trial of a 29-year-old man accused of "sexual assault" on an 11-year old girl.

SOT, Mark Guversan, Lawyer of the accused (France): "Yes, and this is outrageous, we know it's not a rape, she gave her consent, but because they want to rename the status of the case, we will have to plead against it."

SOT, Sandra Hernandez, member of Protection d'Enfants (Children protection) association (French): "Our lawyer, who is a militant since years, and the President of our association, defends the absence of consent under the age of 13 years old. We believe that, under a certain age, which in our believe is under 13 years old, you should not even ask yourself if the children give consent to having sexual intercourse. This is not possible. Children under 13 years old cannot give consent to sexual intercourse with an adult."

SOT, Mark Guversan, Lawyer of the accused (France): "The mistake that has been made by my client was that when he asked her whether she was 18 years old, she answered by moving her shoulder, which was interpreted by my client as a 'yes', the same shoulder movement that she made when he asked her to follow her to the building. Therefore he supposed that she was over 15 years old….17,18."
